Terms and Conditions
1. The Agreement
To book a package with Friends and the City you must place a deposit as specified. By placing a deposit and on completion of a booking form, you accept the terms and conditions on behalf of yourselves and anyone else in your group.
The agreement between yourself and Friends and the City comes into existence once your booking has been formally acknowledged in writing by Friends and the City. Unless you advice us to the contrary we will assume that every member of your party is over the age of 18 years for the packages involving alcohol. Unless you contact Friends and the City in writing within 24 hours of receiving written acceptance, you will be deemed to have agreed to the contract terms. The terms and conditions, general information and booking form constitute the entire agreement between you and Friends and the City. It must be understood that those booking via telephone or e-mail accept our booking terms and conditions without having filled out a booking form themselves.
2. Payment and Booking
If you are booking a package more than 28 days before the date of the tour/event, you must pay a deposit of 25% of the total cost of the package to secure the whole group. Any deposit paid by you will be non-refundable. The balance of the sum due must be paid at least 28 days before the date of the tour/event and if you should fail to make this payment, the deposit will be retained and Friends and the City will consider the package cancelled. If you book a package within 28 days of the date of the tour, the full cost of the package is immediately payable.
3. Price
For the packages where the price is detailed on the website/general information prices shown are correct at the time of going to press, but please note that price may increase or decrease as a result of suppliers and services costs increasing/decreasing or other relevant matters pertinent to your booked package. Friends and the City will advise you in writing of any increase in charges payable which must be paid in full prior to the event date. Friends and the City reserves the right to change any of the tour/event or prices described or quoted before the agreement between you and Friends and the City is concluded. All prices are inclusive of GST.
4. Cancellation
If Friends and the City changes or cancels a package that has been booked, unless you choose to alternative package, any monies paid by you will be returned in full. In the event of an alternative package being booked at a different price to that cancelled, and then an appropriate refund or further payment will be made as applicable. If we are unable to provide any event or service due to any reason beyond our control, a replacement refund will be found.
In the event of you cancelling for whatever reason a booked package, then you may do so at anytime in writing provided that the written notice is received 60 days or longer before the event date then you will forfeit the deposit paid to us. In the event of cancelling the whole of the reservation less than 60 days and more than 28 days before the event date, then half of the tour/event price is payable and in the event of cancellation 28 or fewer days before the tour/event the entire cost shall be payable. Friends and the City will not be responsible for the cancellation if any event due to force majeure.
5. Conduct during the Tour/Event
Reasonable behaviour is expected of all members of your party at all times throughout the duration of your event. If, at any time, Friends and the City believe that there has been any unreasonable behaviour on your part, either towards suppliers or staff members, we reserve the right to discontinue the rest of the event.
All timings allocated to your group must be adhered to. Any lateness on your part can cause chaos to event suppliers and organisers.
If an allocated guide believes he is being treated or spoken to in an inappropriate manner, he has the right to withdraw his services for the rest of the event. This will also constitute removal of your transport service for the rest of the tour/event. You will have to make your own way back to your accommodation.
Friends and the City will not hold responsible for damage to personal belongings throughout your Friends and the City tour/event.
6. Complaints
If you have a complaint regarding any aspect of your tour/event, you must communicate your complaint to the supplier of the service concerned at the earliest opportunity and also contact Friends and the City to let us know of your complaint. If you do not inform the supplier of the service as well as Friends and the City as soon as possible, at least 48 hours of the incident of complaint occurring, Friends and the City will not be held responsible for the complaint. If the complaint has not been dealt with to your satisfaction before your return home, then you must make a complaint to Friends and the City in writing no more than 28 days after your return from the event/tour. If you do not comply with the complaints procedure, Friends and the City will not be responsible for your complaint.
Friends and the City will not be held responsible for any aspect of the tour/event arrangement failing. If such a failure is due to your acts or omissions of a third party not involved in any service which constitute the tour/event for instance; your failure to behave reasonably. Friends and the City will hold every person in the party jointly and severally liable for any damage to property and for any legal cost incurred in defending or pursuing such a claim.
7. Alterations to Bookings
If any alterations or additions are made to bookings after the due date of final payment, as stated in the Booking Confirmation, the individual will be charged $50.00 per change or addition. If you wish to change the date of your tour/event there will be a charge of $150.00. Changes can only be made subject to availability.
8. Laws and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of New South Wales, Australia.
You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia. |
